These Terms & Conditions ("Terms") govern your use of our website (www.filmedby.co.uk) and the purchase of products and services from Filmed By ("we", "us", "our"). By accessing our website or placing a booking, you agree to these Terms. Please read them carefully.
These Terms apply alongside our Rental Agreement, which governs the hire of specific equipment, and our Privacy Policy. Where there is a conflict between these Terms and the Rental Agreement in relation to equipment hire, the Rental Agreement takes precedence.
We may update these Terms from time to time. The version in effect when you place your booking or access our website will apply. We recommend checking this page periodically.
Section 1 — Who We Are
Filmed By is a camcorder hire business registered in England and Wales, with our registered office at 192 Bodmin Road, TR1 1RB, Cornwall, England. Our website is hosted on a third-party e-commerce platform that enables us to offer our products and services online.
Section 2 — Eligibility
By using our website or placing a booking, you confirm that:
You are at least 18 years of age
You are legally capable of entering into binding contracts
You are accessing our services from within the United Kingdom (separate terms apply to Australian customers)
All information you provide is accurate, current, and complete
Section 3 — Placing an Order
3.1 Our website constitutes an invitation to treat, not an offer. A contract between you and Filmed By is formed only when we confirm your booking and payment has been received in full.
3.2 We reserve the right to refuse, cancel, or limit any order at our sole discretion. If we refuse or cancel an order after payment, we will issue a full refund.
3.3 You are responsible for providing accurate booking details, including your delivery address and event date. We are not liable for errors or losses resulting from incorrect information provided by you.
3.4 We reserve the right to limit quantities or restrict bookings to any person, region, or jurisdiction.
Section 4 — Prices & Payment
4.1 All prices are displayed in British Pounds Sterling (GBP) and include VAT where applicable.
4.2 Prices are subject to change without notice. The price applicable to your booking is that shown at the time your order is confirmed.
4.3 In the event of a pricing error, we reserve the right to cancel your order and issue a full refund, or contact you to confirm the correct price before proceeding.
4.4 Full payment is required at the time of booking. We use secure third-party payment processing. We do not store your full card details on our systems.
Section 5 — Products & Availability
5.1 All products and services are subject to availability. We make no guarantee as to the availability of any Equipment at any given time.
5.2 Equipment may be new or pre-owned. Product descriptions and images on our website are provided for illustrative purposes. Minor cosmetic differences may exist between images and the Equipment received.
5.3 We reserve the right to modify or discontinue any product or service at any time without notice.
Section 6 — Accuracy of Information
6.1 We take reasonable steps to ensure the information on our website is accurate and up to date. However, we make no warranty that all information is complete, current, or error-free.
6.2 Information on our website is provided for general purposes only and should not be relied upon as the sole basis for any decision. We reserve the right to correct errors or omissions at any time.
Section 7 — Cancellations, Refunds & Your Right to Cancel
7.1 Statutory right to cancel. Where you purchase as a consumer, you have a 14-day right to cancel from the date of booking under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, provided the service has not commenced (i.e. Equipment has not been dispatched). To cancel, contact us at filmed.by@outlook.com. If you request that the service commence within the 14-day period, your right to a full refund may be reduced on a pro-rata basis reflecting the service already provided.
7.2 Cancellations outside the statutory period are governed by our Rental Agreement (see Section 12 of the Rental Agreement).
7.3 Faulty or misdescribed goods. Under the Consumer Rights Act 2015, if Equipment we supply is faulty, not as described, or not fit for purpose, you are entitled to a repair, replacement, or refund. Please contact us promptly if you believe Equipment is faulty on arrival.
7.4 Refunds, where applicable, will be issued to your original payment method within 14 days of cancellation being accepted.
Section 8 — Intellectual Property
8.1 All content on our website, including text, images, graphics, logos, and video, is owned by or licensed to Filmed By and is protected by copyright and other intellectual property laws.
8.2 You may not reproduce, copy, sell, or otherwise exploit any content from our website without our express written permission.
8.3 You may view, download, and print content from our website for your own personal, non-commercial use only.
Section 9 — User Conduct
You agree not to use our website or services:
For any unlawful purpose or in breach of any applicable law or regulation
To infringe upon the intellectual property rights of Filmed By or any third party
To submit false, misleading, or fraudulent information
To transmit any virus, malware, or other harmful code
To harass, abuse, or harm any person
To attempt to gain unauthorised access to any part of our systems
We reserve the right to terminate your access to our services where you breach these conditions.

12.2 We are not liable for indirect, incidental, special, consequential, or punitive loss, including loss of profits, revenue, data, or goodwill, whether arising in contract, tort (including negligence), or otherwise.
12.3 Nothing in these Terms limits or excludes our liability for:
Death or personal injury caused by our negligence
Fraud or fraudulent misrepresentation
Defective products under the Consumer Protection Act 1987
Any other liability that cannot be excluded or restricted under English law
Section 13 — Your Statutory Rights
These Terms do not affect your statutory rights as a consumer under English law, including rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, and any other applicable consumer protection legislation. These Terms, together with our Rental Agreement and Privacy Policy, constitute the entire agreement between you and Filmed By in relation to your use of our website and services, and supersede all prior agreements, representations, and understandings.
Section 19 — Governing Law & Jurisdiction
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising in connection with these Terms or your use of our website shall be subject to the exclusive jurisdiction of the courts of England and Wales.
Section 20 — Complaints & Alternative Dispute Resolution
20.1 If you have a complaint, please contact us in the first instance at filmed.by@outlook.com. We will endeavour to respond within 5 working days.
20.2 If we are unable to resolve your complaint to your satisfaction, you may be entitled to use an approved Alternative Dispute Resolution (ADR) scheme. Further information is available from Citizens Advice at www.citizensadvice.org.uk.
